    Folks,

    Due to the priority data transfer issue my I-485 application was rejected in June'08 (submitted based on June'08 visa bulletin).

    As part of my application necessary medical exam tests were conducted in May'08. If I were to submit my application today based on the new visa bulletin do you think I need to take all medical exams again and re-submit? Won't the first set of medical exams have any validity?

    Also, on the forums there is a talk about medical forms being changed? Can anyone confirm?

    Another important thing to note is that although GC is for a future employment oppportunity...you clearly state in Labor Application whether the employee is working with u currently....if u answer yes to that (which is the most common scenario) ...u have to provide the address of the location he works at...which shud be consistent with the Recruiting efforts undertaken (in that same area) by the employer......

    So simple by saying that GC is for future employment, u cannot move around unless you clarify that in labor cert.

    Hello,

    Sorry to be posting here but how do I start a new post?
    Here is my situation:

    My husband started GC and our PD is nov 2006. I 140 approved. I am on H1 B. Now, my husband decided to move out of country for studies. So, our application is abandoned right? We have not received any RFEs so can he still apply for AP? Otherwise, how else can he visit USA...H4? Can he still get H4? If yes can it be applied from any US embassy? What all documents are needed? OR should he just try tourist visa now?

    Unfortunately,kaplan doesnt issue I-20's anymore.
    Are you sure than ,while the H1B is being processed ,you can live here legally?
    Also what if I get use premium processing and get my H1B approved earlier,would I be able to start work before Oct 1st?

    My OPT expires in May 2007 and I have my Masters from here...

    Honestly, what does it even matter if it is MS biased? He works at MS, and has every right to focus on that content. :P

    What's needed is a pithy powerful message
    do you have any better ideas for a pithy and powerful message?
    Would be great if we can find a better way to get through our problems and frustrations.

    we ARE professionals and dignified individuals
    some of us are here working for more than 8 years
    Is it dignified to keep working for more than 8 years without a decision on our pending cases?


    We dont seek it as an entitlement
    Once again, to anyone who read the original thread that started this one, we are not claiming entitlement to getting a green card, but is it unreasonable to claim entitlement to a decision on already pending applications within a reasonable amount of time?
    8 years is not reasonable.

    And for the right to free speech on this forum, I wonder why the original thread was closed by the administrator.
    Is this IV's way of saying they do not support the boycott idea?
    Then why not state this explicitly?

    Otherwise, clearly the idea is controversial enough to get mixed reactions, and maybe by leaving it up a better idea can come out of it.

    IV's work is good and should not be undermined, but maybe we can supplement it by additional ways to get a powerful message across.
    how about contributing money to IV? that will help more than stirring up a hornet's nest about boycotts etc.

    as far as powerful messages go, what more powerful message can there be than having a bill or two passed that can help us. with the necessary support from its members, I am confident that IV can deliver.

    who really cares what they put up on those stupdi dates,

    they can make up anything and call the that as a law, no body to question them, not checks and balances
    Thats true, When my I-140 was approved, as per the site my date was atleast 2 months away, but i received the approval notice. :)

    get relief from retrogression. Capture of unused visa numbers etc will make us ignore how many apps USCIS received.

    Good thing is that people will get interim benefits like EAD/AP.

    Yes, at the time of adjudication, you will need employment varification letter that shows Permenent Full time job with same or similar duties and reasonable wage difference.

    I got the Card Production Ordered e-mail today. No LUD even last night at 1 Am. Only one LUD today. My case is processed at Texas service center. And my receipt date is not with in their processing times.

    hi guys,

    my first post at IV.

    I got tired of waiting for my GC and so moved to UK last year on HSMP. After end of 11 months being in UK on HSMP, i filed for extension and received a 4 year "Resident Permit" in 2 weeks.

    So in another 3.5 yrs, will be filing for 'Permanent Residency' and after another 1 year for Citizenship. :)

    Here's another forum which i used and is VERY useful if anyone wants to move.

    From my OWN experience:

    The PROS

    - Simple straight forward process :)
    - definate timeline on residence permit/permanent residency/citizenship
    - spouse gets same level of rights i.e.wife can work & study with any probs
    - family eligible for NHS (even if u dont have a job)
    - 1 month leave is standard; worst employers give only 4 weeks :p
    - kids have fun, get 'british' education (including school uniforms) and most of all, my kids GK has expanded vastly (knows and hear more abt rest of the world)
    - trips to Europe easy and inexpensive (weekend drive to paris is 2.5 hrs and approx 300GBP for family of 4 ;) )
    - excellent public transport system
    - India is only 8 hrs flight and timezone difference only 5 hrs.
    - get to watch and 'play' cricket
    - my british friends love "curry" and eat more 'spicier' then mine
    - having a pint during lunch is 'normal'

    The CONS:
    - VERY expensive place; u make and u spend, have fun but not much savings
    - JOB market is LOUSY - not easy to get a job
    - Jobs are not as high paying compared to USA, plus u are expected to do more (bit like india)
    - smaller houses, cars, roads, etc
    - no real burgers or tacos
    - after some time u start missing USA

    Again, finding a job is very difficult and it does not pay as much as in US. But its not impossible either, i got one ;)

    Before you get carried away please note that even in the Specter Bill people filing for status under Title VI have to

    (a) Wait for the PDs that are pending when the Act passes to become current.

    (b) If the current PDs do not become current in 6 years -- their applications will be "held in abeyance" till the PDs PDs that are pending when the Act passes to become current.

    I take the "held in abeyance" to mean that they might get I-485 filing privileges at that point but those applications will not be adjudicated.

    So you will not really get your green card after 6 years -- you'll be pending till all current PDs become current. Given that family PDs are still back in 1983 per the April 2006 bulletin, they won't be getting their green cards any time soon.

    The parity issue is really that Title VI recognizes that

    (1) worldwide and per-country quotas make no sense -- and yet, the immigrants who go through the arduous labor cert process that protects the American worker are subject to per-country quotas.

    (2) Workers should be mobile and be able to self-petition -- yet skilled workers going through the labor cert process are tied to employer AND job description for years.

    if not...file AR-11 and pray for the best....there is not really that much in terms of options.

    thanks for the reply..this means having a dependent visa is the key at the time of approval..

    if the application was approved and the wife was on h4 (but didnot file her i485 yet..) then she could still file for her i485?

    This is my GC application history

    1. PD for Labor - Aug 2003
    2. Labor(Regular) Application Approved - Nov 2005
    3. i-140 applied in Jan 2006
    4. RFE received question was for company not self, i-140 withdrawn.
    5. Transferred my H1 to the companys sister concern and reapplied for i140 in June 2006.
    6. Applied for i140 premium processing on June 22nd, 2007.

    Current status for i-140 : Recieved and pending at Nebraska service center.

    Questions
    Q1. What is i-140 receipt date for premium processing. Is it the date the fed-ex package is recvd by USCIS or is it a date issued by USCIS that should reach my lawyer?

    Q2. If in case the USCIS need to provide my attorney a receipt date, we have NOT received one as yet. Does that mean they have not even looked at the application as yet?

    Q3. Can i apply for i485 in the worst case that i do not receive approval for i140 by Aug 17th under the concurrent filing rule.

    Any assistance would be highly appreciated.

    I have asked this question before and have called around 4 reps so far. Do I just leave a message or ask for the Congressman / woman? The receptionists are probably not even writing down the messages.
